Kathmandu: An audio clip trending on social media, particularly on TikTok, has sparked public debate and raised legal and ethical concerns. The clip, widely shared with the phrase “Ha Ha Vinaju” (popularly rendered online as ha ha vinaju), is being used by users for entertainment, despite involving verbal abuse and distress of a young woman.
The issue gained wider attention after large numbers of comments repeating “Ha Ha Vinaju” appeared during a live session of “Cool Boy,” also known as Paras Bam Thakuri, a Tiktoker from the Far West. Thakuri, 26, from Kanchanpur, initially said he was unaware of the background of the audio. The context emerged later during the live interaction.
It is not clear who recorded or released the audio or when it was first made public. However, it has been circulating on platforms such as TikTok and Facebook for the past three to four months.
The leaked call recording contains obscene and offensive language used by a young man toward a young woman. In the audio, the man pressures her for personal photos. When she refuses, he makes serious allegations about her character. The woman is heard defending herself and rejecting the accusations. The exchange also includes threats and expressions of extreme anger.
The identity of the man heard abusing the woman has not been confirmed. However, users on social media have turned the victim’s distress into viral content. Many are lip-syncing the audio, remixing it with music, or using it as background sound for videos. Platform algorithms and audio reuse features have further amplified its spread.
The trend has drawn comparisons with past incidents involving leaked intimate content. Many users have normalized the clip, while others have mocked it by associating it with stereotypes about the Far West. Some have also targeted individuals named in the audio.
Experts say the incident raises serious concerns about privacy and digital safety. No formal complaint has been reported so far to police offices in Kanchanpur, Kailali, or Achham. Police officials say legal action becomes difficult if victims do not file complaints. However, recording a private call without consent and making it public is a criminal offense under Nepali law.
Nepal recognizes the right to personal privacy as a fundamental right. Violations can lead to criminal prosecution. Deepak Raj Awasthi, spokesperson for the Cyber Bureau, said such acts send a negative message to society and directly affect a person’s dignity and reputation.
“The Personal Privacy Act applies to audio clips as well,” Awasthi said. “Recording a call without consent and making it public, especially with obscene content, is a serious crime. It amounts to character assassination. A crime remains a crime, whether offline or online.” He warned that users who circulate or enjoy such content could also face legal consequences if a complaint is filed later.
Advocate Baburam Aryal said the case is a clear violation of the right to privacy. He said private conversations are protected and cannot be made public without consent. If the content is obscene or socially harmful, additional legal provisions also apply. Aryal also referred to the Supreme Court’s concept of the “right to be forgotten,” noting that even content available online cannot be freely misused by others.
Anil Raghuvanshi, president of Child Safe Net, said the issue should also be viewed from a mental health and social responsibility perspective. He said creating, sharing, or remixing such content is illegal under the Electronic Transactions Act and the Penal Code. In some cases, even storing such material can be unlawful.
Raghuvanshi said Nepali society often responds to such incidents with victim-blaming attitudes. He added that limitations in content moderation, especially for Nepali-language material, allow such trends to spread unchecked. He urged users to report such content immediately and refrain from sharing or engaging with it.
